日本の規制の多くは、「国民は自分で判断できないので、国民の行動規範は政府が決めます」という政府のパターナリズムと、正義や弱者保護をタテマエにして自分の既得権益を死守したいだけの、実際は弱者でもなんでもない勢力による政治過程、その２つの融合によってできている。ネットの薬販売規制などはその典型だろう。こうした規制やパターナリズムは、決して善や正義そのものではないし、むしろ善や正義に反する場合が少なくない。規制やルールを正しいと思い込むのは、＜問題を考え抜いていない＞のだ。＜問題を考え抜いていない＞から、政府を利用する既得権益者に「カモられる」のである
